Domio Service Terms and Conditions_v.1

  1. Preliminary Provisions

1. These terms and conditions (“Terms and Conditions”) define the rules for using the Domio service (“Service”), operating as a bot in the Telegram application, as well as the conditions for service provision by Domio Nieruchomości Jarosław Jakowenczuk, NIP 6832140200 (“Service Provider”).

2. Beginning to use the Service means accepting the Terms and Conditions and undertaking to comply with them.

4. Definitions used in the Terms and Conditions:
Service – the Domio bot available exclusively in Telegram;
Service Provider – Domio Nieruchomości Jarosław Jakowenczuk, NIP 6832140200;
User – any individual who uses the Service;
Customer – an entity that concludes a contract with the Service Provider for the use of the Service;
Listing – a property offer presented in the Service, originating from external services or social media;
Advertiser – the entity publishing the Listing in its source service;
Price List – a set of fees and access plans for the Service;
Order – a declaration of intent by the Customer concerning the choice of a plan;
Agreement – an agreement for the provision of electronic services concluded on the basis of these Terms and Conditions;
Partner – an external entity providing services to the User in its own name after contact details are transferred via the Service;
Account – the permissions assigned to the User within the Service system, linked to the Telegram identifier.

2.Purpose of the Service

The Service is used to search and organise real estate listings, in particular apartments available without commission for the buyer/tenant. The purpose of the Service is to facilitate the User’s search by aggregating and filtering publicly available information.

  1. Conclusion and Duration of the Agreement
  1. The Agreement is concluded when the Service Provider grants access to the Service after successful payment.
  2. Using the Service requires prior acceptance of these Terms and Conditions and the Privacy Policy.
  3. Acceptance occurs by clicking the “I accept the terms and the privacy policy” button displayed upon first launching the Domio bot in the Telegram application.
  4. Failure to accept the Terms and Conditions makes it impossible to use the Service.
  5. The Service system records the date, time and version of the accepted Terms and Conditions assigned to the user’s Telegram identifier.
  6. The User declares that before acceptance, they have reviewed the Terms and Conditions and the Privacy Policy and accept their content in full.
  7. The Service Provider may provide a paid trial period (e.g. 3 days for 4.99 PLN), after which – unless the User cancels the subscription – recurring billing begins according to the selected plan.
  8. The Agreement is concluded for an indefinite period with recurring billing every 14 or 30 days until the User resigns.
  9. Subsequent subscription payments are automatically charged to the payment card stored in the Stripe payment operator system.
  10. Payment card data is stored exclusively by Stripe – the Service Provider has no access to it and cannot modify it.
  11. The User may cancel the subscription (disable automatic renewal) at any time through:
    • the “Cancel subscription” button directly in the Telegram chatbot, or
    • contact with the Service Provider via e-mail: kontakt@domioestate.pl.
    • Cancelling the subscription means the Service access expires at the end of the period already paid for.
  1. Termination and Resignation
  1. The agreement for the provision of Domio services is concluded for an indefinite period and remains valid until the User resigns.
  2. Failure to cancel the subscription before the end of the current billing period constitutes the User’s consent to automatic charging for the next period and continuation of access to the Service.
  3. The User may resign at any time via:
    • the “Cancel subscription” button in the Telegram chatbot, or
    • an e-mail to kontakt@domioestate.pl requesting cancellation.
  4. Cancelling the subscription results in termination of the service at the end of the paid billing period.
  5. Fees paid for the current subscription period are non-refundable.
  6. In the event of a significant violation of the Terms and Conditions by the User, the Service Provider may suspend service provision or terminate the agreement with immediate effect – without the right to a refund.
  1. Using the Service requires prior acceptance of these Terms and Conditions and the Privacy Policy.
  2. Acceptance occurs by clicking the “I accept the terms and the privacy policy” button.
  3. Failure to accept prevents use of the Service.
  4. The system records the date, time, and version of acceptance.
  5. The User declares having reviewed and fully accepted them.
  1. Rules of Use
  1. Only adult natural persons with full legal capacity may use the Service.
  2. It is forbidden to share the account with third parties, mass-download data, or use the Service in a manner inconsistent with its intended purpose.
  3. Violations may result in blocking or deleting the account without refund.
  4. It is forbidden to use the Service in a manner contrary to the law, good practices, the safety of other users, or to circumvent Service mechanisms.
  1. SERVICE PROVIDER LIABILITY DISCLAIMER
  1. The Service Provider exercises due diligence to ensure correct functioning of the Service but does not guarantee full timeliness, completeness, or accuracy of Listings originating from external services beyond its control.
  2. The Service Provider is liable only for actual damages incurred by the User that result directly from improper performance of the Agreement, within the limits permitted by applicable law.
  3. The Service Provider is not liable for lost profits (lucrum cessans) unless such liability arises directly from mandatory legal provisions.
  4. The Service Provider is not liable for interruptions caused by force majeure, technical failures, third-party actions, or necessary service work.
  5. The Service Provider is not liable for actions or omissions of Domio Partners, who provide services to Users in their own name and responsibility. Domio only facilitates establishing contact with a Partner.
  6. The Service Provider is not a party to agreements concluded between the User and a Partner and does not guarantee quality, timeliness, or legality of Partner services. All claims must be directed to the Partner.
  7. Domio does not participate in concluding rental or purchase agreements for real estate. The Service does not constitute legal, financial, or credit advice.
  8. Nothing in the Terms and Conditions excludes or limits the Service Provider’s liability towards a consumer in a manner contrary to applicable law.
  1. Fees, Order Fulfilment and Settlements
  1. Using the Service is subject to fees according to the Price List.
  2. Payments are made electronically via Stripe.
  3. The User confirms a purchase by clicking “I order and pay”.
  4. Access to the Service is activated automatically once payment is booked by Stripe.
  5. Order fulfilment time is a maximum of 1 business day.
  6. An invoice or receipt is sent electronically to the User’s e-mail.
  7. Refunds (e.g. due to an incorrect payment) are made to the same account from which the payment was made.
  1. No Right of Withdrawal
  1. Under Article 38(13) of the Polish Consumer Rights Act of 30 May 2014, the User has no right to withdraw from the agreement if the provision of the digital service began with their explicit consent before the expiry of 14 days, and they were informed about the loss of this right.
  2. Before payment, the User consents to the immediate start of the Domio service and confirms the loss of the right of withdrawal.
  3. After payment, access to the Service is activated automatically and the agreement is considered executed.
  1. Changes to the Terms and Conditions
  1. The Service Provider may amend the Terms and Conditions for important reasons, including legal changes, functionality expansion, technological updates, the need to ensure security, or service quality improvement.
  2. Any change will be communicated to the User via a message in the Domio bot in Telegram at least 7 days before it becomes effective.
  3. Continuing to use the Service after the effective date constitutes acceptance of the amended Terms and Conditions.
  4. If the User does not accept the changes, they may cancel the subscription at any time.
  5. The Service maintains an archive of Terms and Conditions versions, and each acceptance is assigned to a specific version.
  6. For changes affecting payments, subscriptions, or consumer rights, the Service Provider may require renewed acceptance in the bot.
  1. Complaints
  1. The User may submit complaints regarding the functioning of the Service, quality of services, or billing.
  2. Complaints may be submitted via:
    a) e-mail: kontakt@domioestate.pl
    b) message in the Domio bot in Telegram, if appropriate to the communication channel.
  3. A complaint must include at least:
    a) User’s first and last name,
    b) e-mail address or contact number,
    c) problem description and circumstances,
    d) transaction number (if related to payment).
  4. If the complaint lacks necessary data, the Service Provider may request supplementation.
  5. Complaints are reviewed within 14 calendar days, and responses are sent via e-mail or Telegram.
  6. In complex cases, the period may be extended by another 14 days; the User will be informed with the reason for the delay.
  7. If the complaint is rejected, the User may:
    a) request reconsideration,
    b) use ADR or the ODR platform at https://ec.europa.eu/consumers/odr
    c) pursue claims in court.
  1. Personal Data Protection
  1. The administrator of User personal data is Domio Nieruchomości Jarosław Jakowenczuk, NIP 6832140200.
  2. Personal data is processed in accordance with GDPR and the Polish Data Protection Act. Detailed rules are described in the Domio Privacy Policy: https://domioestate.pl/polityka-prywatnosci/
  3. Data is processed for:
    a) provision of the Service,
    b) payment processing and subscriptions,
    c) communication with the User,
    d) statistics and analytics based on the Service Provider’s legitimate interest,
    e) complaint handling and support.
  4. Processed data includes: Telegram identifier, name (if provided), e-mail address, phone number (if provided), activity data in the Service, and data necessary for payments.
  5. Data may be transferred to:
    a) Stripe (transaction handling),
    b) IT and hosting providers,
    c) Domio Partners (e.g. mortgage advisor, construction team).
  6. Data may be transferred to third countries (Telegram, Stripe); GDPR safeguards such as Standard Contractual Clauses apply.
  7. Data is stored for the provision period and for accounting purposes for 5–6 years.
  8. The User has the right to:
    a) access data,
    b) rectify data,
    c) delete data,
    d) restrict processing,
    e) object,
    f) data portability,
    g) lodge a complaint with the Polish Data Protection Authority.
  9. Providing data is voluntary but necessary to use the Service.

  1. Final Provisions
  1. Polish law applies to the Agreement and use of the Service.
  2. In matters not regulated here, the following shall apply:
    a) Civil Code,
    b) Act on the Provision of Electronic Services,
    c) Consumer Rights Act,
    d) GDPR and the Data Protection Act.
  3. Consumer disputes may be resolved via ADR: https://uokik.gov.pl
  4. Users may use the EU ODR platform: https://ec.europa.eu/consumers/odr
  5. For non-consumer Users, the competent court is the one appropriate for the Service Provider’s registered office.
  6. The Terms and Conditions are made available in the Domio Telegram bot (as a durable medium) and online on the Service Provider’s website.
  7. The Service Provider may amend the Terms and Conditions for reasons specified in point 1.6. Changes apply after informing the User.
  8. Continued use after changes means acceptance.
  9. If the User does not accept changes, they may stop using the Service and cancel the subscription at any time.
